MyJoyonline has reported that Ghanaian music producer Koby Spiky Nkrumah has won a legal battle against the Confederation of African Football (CAF) for copyright infringement.
The case was heard at the Commercial Court 7 in Accra on Wednesday, July 17, 2024. The court ruled in favour of Spiky, finding CAF guilty of using the beat of his music titled, ‘Okomfo Anokye,’ without seeking his permission for promotional materials for the 2018 CAF awards.
Justice Emmanuel Loddoh, who presided over the case, awarded damages of Ghana Cedis equivalent of USD250,000 and a legal cost of GHS 40,000 against CAF.
Spiky, also known as Kwabena Ofei-Kwadey Nkrumah, expressed that CAF’s actions showed a lack of respect for his intellectual property rights, resulting in financial losses from the potential commercial use of his music.
Before taking legal action, Spiky had publicly called out CAF for copyright infringement in 2019, stating that despite an email from CAF admitting to using his work without consent and apologizing, they did not respond to his demand for compensation.
They also denied using the soundtrack for commercial purposes, citing that the CAF Awards was not a profit-making venture.
They further explained that they deleted the work from their social media accounts and apologised to Spiky.
