The Court of Appeal in Jamaica has mandated the release of dancehall artist Vybz Kartel and his co-defendant, overturning the decision for a retrial and exonerating them of the 2011 murder of Clive “Lizard” Williams.
Justice Marva McDonald-Bishop, the newly appointed President of the Court, announced that the ruling was unanimous.
She highlighted that the judges considered 12 key factors in their deliberation, which included the gravity of the offense, the robustness of the prosecution’s case, the accessibility of witnesses, the feasibility of conducting a retrial in a timely manner, and the financial implications of such a retrial.
Significant considerations influencing the judges’ ruling included the prosecution’s inadequate justification for the availability of its witnesses, the anticipated duration for a new trial (estimated at 15 years), the “unjustifiable interference” with the appellants’ rights to a fair and timely hearing during the initial trial, potential biases against the appellants, and the intricate nature of the case, encompassing its duration, costs, and the demand on court resources.
She indicated that the impact of a retrial on the appellants, who have already endured 13 years in custody, was a significant consideration in their decision-making process.
Justice McDonald-Bishop presided over the panel of three judges reviewing the case, which included Justices Paulette Williams and David Fraser.
In June, the Court of Appeal engaged in six days of comprehensive legal discussions from both the defense and the prosecution.
Defense attorney Isat Buchanan contended that an acquittal is essential to avert further violations of constitutional rights for Vybz Kartel and his three co-defendants.
On the other hand, Acting Director of Public Prosecutions Claudette Thompson maintained that Vybz Kartel and his co-defendants should not evade justice due to a technicality.
She emphasized that considering the gravity of the offense, the robustness of the case, the public interest, and the presence of witnesses, a retrial is warranted.
Thompson argued that the hardships faced by the accused do not provide adequate grounds to forgo a retrial.
Vybz Kartel, along with Shawn ‘Shawn Storm’ Campbell, Kahira Jones, and Andre St John, were charged with the murder of Clive ‘Lizard’ Williams in September 2011.
The four were convicted in March 2014 and sentenced to life in prison the following month. Their convictions were upheld by the Court of Appeal in 2020.
