In a significant ruling by the ECOWAS Court of Justice, Shalimar Abbiusi, spokesperson for the emerging political movement New Force, has been vindicated after being rearrested and deported by Ghanaian authorities in December 2023.
The court found that the actions taken against her violated Article 6 of the African Charter on Human and Peoples’ Rights, which guarantees the fundamental right to liberty.
Expressing her relief and triumph after the judgment, Shalimar stated, “The ECOWAS Court ruled that my rearrest and my deportation were against the law and in violation of Article 6, which protects the human right to liberty.
So, the state has to compensate me now. They have to pay me damages. Today is an amazing day. This is victory. Justice has prevailed.”
The incident that led to this landmark decision traces back to December 19, 2023, when Shalimar was allegedly detained and subsequently deported under controversial circumstances.

She filed a petition at the ECOWAS Court, challenging the legality of the state’s actions. According to her, the ordeal not only violated her rights but was also an affront to justice and the rule of law.
In a social media post on X, she reiterated her gratitude and sense of justice. “ECOWAS Court rules that rearrest and detention on 19th December 2023 and eventual deportation of Shalimar Abbiusi was unlawful violation of liberty. I am vindicated—I thank God,” she wrote.
The ruling has drawn attention to the growing influence of ECOWAS in upholding human rights across West Africa. Legal experts and civil society groups have hailed the decision as a victory for individuals who face state-led persecution.
This decision also sets a precedent for other political activists in the region who face similar challenges.
With Ghana now obligated to compensate Shalimar for damages, the case serves as a stark reminder to governments within ECOWAS to adhere to international protocols and human rights conventions.
Speaking further about her plans, Shalimar indicated that this victory is just the beginning of her journey. “This ruling isn’t just about me; it’s about every individual who’s ever been silenced or oppressed. The fight for justice must continue,” she said in a follow-up statement.
