Actress Reese Witherspoon has filed for divorce after announcing her separation from Jim Toth.

According to court documents acquired by PEOPLE, the Academy Award-winning actress, 47, cited “irreconcilable differences” as the basis for their divorce when she filed for divorce on Saturday in Davidson County, Tennessee, and stated that she and Toth signed a prenuptial agreement in March 2011.

She also requests that she and Toth be designated as joint guardians of their 10-year-old son, Tennessee James.

The couple waited about a week to file the documents after posting a statement on Instagram announcing their separation.

“We have some personal news to share…” they began. “It is with a great deal of care and consideration that we have made the difficult decision to divorce. We have enjoyed so many wonderful years together and are moving forward with deep love, kindness and mutual respect for everything we have created together.

“Our biggest priority is our son and our entire family as we navigate this next chapter. These matters are never easy and are extremely personal. We truly appreciate everyone’s respect for our family’s privacy at this time,” the pair added.

Witherspoon and Toth got married in 2011, several years after Witherspoon’s divorce from actor Ryan Phillippe was finalized in 2008.

They share a son, Tennessee, who was born in September 2012. Witherspoon also has two children, Ava and Deacon, with Phillippe.

Despite the divorce, Witherspoon and Toth plan to keep working together. In their statement on social media, they said they were moving forward with “deep love, kindness, and respect.”
