The Member of Parliament for Assin North, James Gyakye Quayson has sued the MP for Adansi-Asokwa KT Hammond for making comments that he deems to be contemptuous and prejudicial to the criminal battle he is currently facing.
On Friday, July 7, 2023, attorneys for Assin North Member of Parliament James Gyakye Quayson filed a writ with the High Court, charging Minister of Trade and Industry Kobina Tahir Hammond with contempt for an interview he gave to a Kumasi-based television, Oyerepa FM.
Gyakye Quayson’s attorneys say that KT Hammond’s media interview goes against their client’s constitutional right to a trial in which he is considered innocent. Lawyer Justin Pwavra Teriwajah claimed in the writ that the Respondent’s comments were highly damaging to the court’s legal proceedings and so constituted contempt of court.
He also said that KT Hammond is openly taking over the job of the trial judge. To maintain the integrity of the judicial system, he said, the Court has the authority under Article 126(2) of the 1992 Constitution to commit KT Hammond and others like him to contempt of court.
The writ asks the Court to bring the Minister to trial for contempt of court and to impose a jail term on him if he is found guilty. KT Hammond predicted Gyakye Quayson’s incarceration in an interview aired on Oyerepa TV in Kumasi on Tuesday, July 4, 2023.
James Gyakye Quayson is on trial for perjury in Accra’s High Court. He is being investigated for forgery and perjury in connection with suspected crimes committed prior to the 2020 parliamentary election in Assin North.
Five charges against him included forging a passport or travel document, knowing submission of a false statutory statement, perjury, and filing a false declaration for public office, but he pleaded not guilty to all five.
