Following a protracted legal battle, Spotify has emerged victorious in a case concerning the unauthorized streaming of Eminem’s music.
Despite a court ruling that Spotify streamed the rapper’s songs without a proper license, the platform has successfully navigated a five-year lawsuit initiated by Eminem in 2019 through his publisher, Eight Mile Style.
The lawsuit accused Spotify of failing to secure the necessary licenses before making his music available on the service.
Although the court acknowledged that Spotify lacked the appropriate licensing for the tracks in question, a finding of guilt would not have required Spotify to compensate Eminem directly; instead, Kobalt Music Group, which manages Eminem’s royalties for Eight Mile Style, would have been responsible.
The question arises: why did Eminem lose this case? The lawsuit was filed because Spotify had falsely claimed to possess licenses for 243 of his songs.
Eight Mile Style contended that despite these tracks being streamed billions of times, Spotify had not compensated them adequately, instead making arbitrary payments that only represented a small fraction of the actual streams.
This situation was characterized by the publisher as “willful copyright infringement.”
Interestingly, Eminem was not aware of the lawsuit during this period, and his music continued to be available on the platform.
In response to the allegations in 2020, Spotify attributed the issue to Kobalt Music Group, asserting that the company, responsible for administering Eminem’s rights, had misled them into believing they had the necessary licenses to stream his music.
Essentially, Spotify claimed that Kobalt had entered into a licensing agreement without actually holding the rights from Eight Mile.
At this stage, the case began to oscillate between Eight Mile, Spotify, and the recently introduced defendant, Kobalt.
There was a significant pause in proceedings regarding the potential deposition of Spotify CEO Daniel Ek.
Ultimately, all parties reached a consensus to pursue a summary judgment to circumvent a lengthy jury trial.
