Ex-Presidential staffer Charles Bissue has petitioned the High Court to stop an investigation into his possible involvement in corruption and corruption-related crimes committed by a public official.
Mr. Bissue claims that the investigation cannot begin until he is provided with a copy of the petition that serves as the foundation for the investigation.
However, in light of this and despite a suit against the OSP, the Office informed him of ongoing investigations into the operations of the IMCIM in a letter dated May 3, 2023. The letter states that he must make himself available for an interview since he is still a person of interest.
Since the release of the documentary by Anas Aremeyaw Anas, Mr. Bissue has sued the Special Prosecutor twice. He had previously claimed that he was innocent since the police had already looked into the situation and cleared him.
He wants the court to rule that the OSP lacks the authority to evaluate a police investigation since that is not what the OSP Act, 2017 (Act 959) says. He wants a statement stating that the OSP’s investigative and prosecutorial powers under Act 959 do not apply to him because the police have already looked into the situation.
Mr. Bissue also asks the court to rule that OSP must look into Anas and Tiger Eye P.I. before it may probe him. Finally, he wants an injunction prohibiting the OSP from investigating him for the same issue that the police are looking into, unless the police send the case to the OSP.
In December of last year, the OSP announced that it was investigating a number of people and organisations for corruption in connection with illegal mining. These included the indigenous mining company Akonta Mining Limited, Mr. Bissue, members of the Lands Commission, the Forestry Commission, and the Ministry of Lands and Natural Resources, as well as various mining organisations, people, and political party officials.
Mr. Bissue, however, has denied the claims made about him in the documentary. Meanwhile, in July of this year (2019), Mr. Bissue was cleared of any wrongdoing or allegations of corruption by the Criminal Investigations Department (CID) of the Ghana Police Service.
According to the CID’s investigation, the documentary’s depiction of events between Mr. Bissue and Yaw Ben of ORR Resource Enterprise was inaccurate.
The Tiger Eye documentary was an important source for the CID, along with other information, but the documentary’s primary investigator, Mr. Anas Aremeyaw Anas, “failed to avail himself to assist in investigations” and “failed to provide a copy of the unedited version of the documentary,” according to the CID report.
