Former Finance Minister Ken Ofori-Atta has taken legal action against the Office of the Special Prosecutor (OSP), challenging its decision to declare him wanted.
In a suit filed at the High Court, Human Rights Division, Ofori-Atta argues that the OSP exceeded its legal mandate by using a media briefing to make the declaration, violating his constitutional rights to liberty and movement.
He contends that:
- The OSP has no authority to declare individuals wanted, as this falls under police jurisdiction.
- The announcement lacked legal backing and breached the Office of the Special Prosecutor Act, 2017 (Act 959).
- The move violates both Ghana’s Constitution and international human rights treaties.
Ofori-Atta is demanding the removal of his name and image from the OSP’s wanted list, compensation for damages, and an injunction to prevent any further declarations against him.
